TERMS OF SERVICE & DATA USE POLICY
For Engineer and Company Accounts

This Terms of Service & Data Use Policy ("Policy") is a legal agreement between you ("User," "you") and Enki Tech LLC ("Enki Tech," "NEPI," "we," "us," or "our"), the operator of the National Engineering Portal of Iraq (the "Platform"). By creating an account, you confirm that you have read, understood, and agree to be bound by this Policy. If you do not agree, you must not register for or use the Platform.
This document applies to both Engineer Users and Company Users. Sections that apply only to one account type are labeled accordingly. This draft is provided for internal review and must be finalized with qualified legal counsel prior to publication, particularly regarding applicable data protection, consumer protection, and electronic transaction law in Iraq and any other jurisdiction in which Users are located.
1. Definitions
"Platform" means the NEPI website, applications, and related services operated by Enki Tech LLC.
"Engineer User" means an individual who registers an engineer account to create a professional profile.
"Company User" means a business entity that registers a company account to search for and engage engineering talent.
"Public Profile Data" means information an Engineer User submits that is displayed publicly on the Platform once published, including name, professional summary, governorate, discipline, experience, education, and skills.
"Private Contact Data" means an Engineer User's phone number and email address, or a Company User's private business phone and email, which are not publicly displayed and are only released through the Platform's controlled contact-reveal process.
"Aggregated or De-identified Data" means data that has been combined, summarized, or stripped of information capable of identifying a specific individual or company.
2. Accounts and Eligibility
You must provide accurate, current, and complete information when registering. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Each individual may hold one Engineer account; each business may hold one Company account, unless otherwise permitted by Enki Tech in writing.
Company Users are subject to administrative verification before gaining search access or the ability to reveal engineer contact details. Enki Tech may approve, reject, suspend, or ban a Company account at its discretion, consistent with its internal verification procedures.
3. Data We Collect
3.1 From Engineer Users
Public Profile Data, as defined above, which you control and may edit, publish, hide, or delete.
Private Contact Data (phone number and email), stored separately from your public profile and never displayed publicly.
3.2 From Company Users
Public company information, including company name, address, and optional website or social links.
Private business contact information, used for verification and platform communication.
3.3 Automatically Collected Data
Standard technical data such as login activity, search activity, and contact-reveal activity, collected for security, audit, rate-limiting, and abuse-prevention purposes.
4. How We Use Your Data
Enki Tech uses the data described above for the following purposes:
To operate the Platform, including account management, profile publication, engineer search, and the controlled contact-reveal process described in Section 5.
To verify Company User identity and eligibility before granting search or contact-reveal access.
To maintain security, audit trails, and abuse detection, including logging of administrative actions and contact reveals.
To maintain, support, and improve the Platform, including analyzing usage patterns, improving search relevance, and developing new features.
Subject to Section 6 below, to promote and market the Platform in ways intended to benefit both Engineer Users and Company Users, such as highlighting in-demand skills, regional hiring trends, or platform success outcomes.
Enki Tech does not sell Private Contact Data to third parties. Private Contact Data is disclosed only through the audited, one-engineer-at-a-time contact-reveal mechanism described in Section 5, and only to Company Users that have been administratively approved.
5. Contact Reveal Mechanism
An approved Company User may request the Private Contact Data of a specific, published, and active Engineer User through a controlled Platform function. Each such request is individually recorded, including the identities of the requesting company and the engineer, and the date and time of the request. This record may be reviewed by Enki Tech for verification, dispute resolution, rate-limiting, and abuse-prevention purposes.
Engineer Users acknowledge that publishing a profile makes their Public Profile Data visible to approved Company Users and the general public, and makes their Private Contact Data available for reveal by approved Company Users, subject to the controls described in this Policy. Engineer Users may unpublish or hide their profile at any time to stop future contact reveals; requests already completed prior to that change cannot be retracted.
6. Marketing and Platform Enhancement Use
You grant Enki Tech a non-exclusive, worldwide, royalty-free license to use, reproduce, and analyze the data you provide for the purpose of operating, maintaining, supporting, and enhancing the Platform, and for marketing the Platform in a manner intended to benefit both Engineer Users and Company Users, subject to the following limitations:
Marketing use of identifiable Public Profile Data (for example, featuring a named engineer or company in a case study, testimonial, or promotional feature) requires your separate, specific consent at the time of the feature, which you may decline without affecting your account or access to the Platform.
Aggregated or De-identified Data may be used by Enki Tech for market research, industry reports, platform statistics, and promotional or marketing materials without further consent, provided such data cannot reasonably be used to identify a specific individual or company.
Private Contact Data is never used for marketing purposes and is never shared with third parties for their own marketing use.
You may withdraw marketing consent for identifiable features at any time by written request to Enki Tech; this does not affect Enki Tech's ability to use Aggregated or De-identified Data as described above.
7. Data Retention and Deletion
Enki Tech retains your data for as long as your account is active and as required to operate the Platform, comply with legal obligations, resolve disputes, and enforce this Policy. You may request deletion of your account at any time. Upon a verified deletion request, Enki Tech will remove your account, profile data, and private contact data in accordance with its standard deletion procedure, subject to any backup retention period required by its hosting and infrastructure providers.
8. Your Rights
Subject to applicable law, you have the right to access, correct, and request deletion of your personal data, and to withdraw consent for specific uses described in this Policy where consent is the basis for that use, as described in Section 6. To exercise these rights, contact Enki Tech using the details in Section 12.
9. Security
Enki Tech applies administrative, technical, and organizational safeguards designed to protect your data, including role-based access controls, audited disclosure of private contact data, and restricted administrative access. No method of transmission or storage is completely secure, and Enki Tech cannot guarantee absolute security.
10. Changes to This Policy
Enki Tech may update this Policy from time to time. Material changes will be communicated through the Platform prior to taking effect. Continued use of the Platform after a change takes effect constitutes acceptance of the revised Policy.
11. Governing Law
This Policy is governed by the laws of Iraq, without regard to conflict-of-law principles. [Placeholder — venue and dispute-resolution mechanism to be confirmed with legal counsel.]
